Terms & Conditions

(1) Booking Deposit, Fees and/or Payment: The Client shall make a deposit, fee (or) payment determined by Blaze Your Own Trail Photography to retain a Studio, Horseback ride, Pony ride, or any event location to perform the services specified in a contract.

(2) Cancellation: A 24hr notice must be given If the Client wishes to cancel an Agreement between Blaze Your Own Trail Photography and the Client. Any booking fee, deposit or payment paid to Blaze Your Own Trail Photography shall be refunded in full even If the Photographer is NOT able to secure another client for the same date. If the cancellation occurs less than (24hrs) before the session date, the Client forfeits any booking fee, deposit or payment paid to Blaze Your Own Trail Photography.

(3) Photographic Materials and Copyright: All photographic materials, such as original negatives (if any), photos, videos, slides, are the exclusive property of the Blaze Your Own Trail Photography. Blaze Your Own Trail Photography shall own the copyright for all images created and may use the work for samples, contests, exhibition, advertising and promotion. Any use outside of these terms & conditions will require the consent of the client.

(4) Client’s Usage: The Client can obtain prints for personal use only, and shall not sell any prints or authorize any sell/reproductions by parties other than Blaze Your Own Trail Photography. If Client is obtaining a print for reproduction/print for resell, Blaze Your Own Trail Photography authorizes Client to reproduce the print only as set forth under Special Requirements. In such event, Client shall request that a copyright and credit notice for Blaze Your Own Trail Photography, and its logo be placed adjacent to the photograph on publication. If the publication refuses or omits to agree to these terms and conditions, said publication is not authorized to use any photographic material produced by Blaze Your Own Trail Photography.

(5) Failure to Perform: If Blaze Your Own Trail Photography is unable to perform any or all terms of this Agreement due to casualty, overbooked, or other cause beyond their control, or due to illness, then Blaze Your Own Trail Photography shall return any funds, booking fee, deposit or payment previously paid by the client. Blaze Your Own Trail Photography and the client shall have no further liability with respect to these terms and conditions. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Blaze Your Own Trail Photography.

(6) Files: Blaze Your Own Trail Photography will keep the client files for up to 90 days after the photography session, and is not liable for any claims after this period. All client files will be deleted and backups will be purged after this period.

(7) Liability: It is the client’s responsibility to take care of their children; Blaze Your Own Trail Photography does not accept any responsibility due to any accident to children or damage to public or private properties during the photo shooting or consultation session caused by children or irresponsibilty of the client.

(8) It is understood that no other photographer, amateur or professional, shall be allowed to photograph at the venue (Horseback ride, pony ride, wedding, portrait, youth event, birthday party, family photography , etc.) while Blaze Your Own Trail Photography is working, and that any breach of this agreement will constitute a reason for non-completion of the job with no liability to Blaze Your Own Trail Photography and loss of initial deposit, fee, payment paid by the client. 

(9) Client accepts that all photographs will be taken and edited at Blaze Your Own Trail Photography's discretion based on their experience and artistic view. If the client has special requests, they shall create a “list” of all shots that they require additional edits and shall pay an additional cost for these revisions.

(10) All images produced by Blaze Your Own Trail Photography will include standard image editing (including: basic enhancement, light and colour adjustments, formats etc). Any special edits requested by the client there will be an additional cost per image if accepted by Blaze Your Own Trail Photography. Fee or payments for this service will be agreed upon prior to the task being performed.

(11) It is understood that it is the responsibility of the client to inform Blaze Your Own Trail Photography by phone, by email, by text for any date or location changes. Blaze Your Own Trail Photography is not liable for any claims of text messages sent by mobile or social network websites not recieved.

(12) Photographic Cooperation: In the event that family/guests, or any other resources are taking photos, Blaze Your Own Trail Photography is not responsible for obstructed photos ruined due to other flashes going off or due to any other behaviour from guests. Blaze Your Own Trail Photography is not responsible for obstructed or ruined photos due to activities by other vendors, venue staff, horses or ponies beyond our control.

(13) Liability Waiver: A required seperate liability waiver provided by any venue, company, organization etc, that is not controlled by Blaze Your Own Trail Photography shall be signed by the client prior to any services being performed.

(14) Blaze Your Own Trail Photography operates as an independent entity, unaffiliated or financially supported by any other entity other than itself.

(15) All communications with Blaze Your Own Trail Photography shall be made in English.
